General terms and conditions for distance selling by OnFoil/Sclimpré C&S bv



The customer must always read the general terms and conditions for distance selling before placing an order. Placing an order on the website or by telephone is considered as express acceptance of the general terms and conditions for distance selling.

2. Generalities and definitions
Only the current sales conditions apply to the remote sale by OnFoil to end users. All other conditions, even those included on the purchaser's order form, are excluded. OnFoil may at any time make changes to these general sales conditions. However, the conditions that were applicable at the time the sale was concluded will always apply to current contracts. The customer will receive the general conditions together with the confirmation of the order.

Where stated, the provisions shall only apply to purchases made by a consumer, i.e. any natural person acting for purposes which are outside his trade, business, craft or profession.

3. Establishment of distance selling
To reserve or order a product online, the customer must add it to his shopping cart. He then chooses the delivery method, fills in his customer details and chooses the payment method. Finally, to complete the reservation or order, the customer must press the button labelled “pay” and make the payment (unless payment upon delivery is provided).

If an obvious error has been made in the description of the product or the price indication on the website, despite the great care that OnFoil takes to ensure the accuracy of the information, OnFoil may cancel the order.

In the event of force majeure, OnFoil may suspend its obligations for the duration of the force majeure or permanently terminate the agreement.

4. Transfer of ownership
The goods remain the exclusive property of OnFoil until full payment of the invoice. Despite this retention of title, the risk of loss or damage is transferred to the customer upon taking possession of the goods.

5. Prices
Our prices include VAT and other taxes and contributions. All offers are valid as long as they are included on the website. The indicated prices can change at any time. If an order is placed, the price that was applicable at the time of the order applies to this distance sale.

6. Payment
The customer can pay for his order:
- a) directly in a secure environment with Bancontact
- b) via classic transfer to account number BE28 7512 0279 5920

When ordering for home delivery or collection point delivery by courier, the customer must always pay in full when placing the order.

7. Delivery
All goods will be delivered to the address or collection point specified by the customer. OnFoil remains responsible for the delivery until the customer has actually received the goods.

8. Delivery time
For goods that are in stock at the time of ordering, the estimated period within which the order will be delivered or will be available at the collection point is stated.
For goods that are not in stock at the time of order, a delivery period of maximum 30 days applies, unless expressly agreed otherwise.

OnFoil is not liable for any consequential damage due to late delivery or non-delivery by the carrier, but will make every effort to find a solution.

9. Warranty conditions for consumers
Consumers are entitled to a statutory 2-year warranty.

- During the first 12 months, a defect is presumed to have existed upon delivery, unless OnFoil proves otherwise.
- The customer must report any defect within two months of discovery.
- OnFoil is only responsible for repairs or replacements via its own after-sales service. If the customer himself calls upon the manufacturer or an unauthorized third party, the warranty will be void.

10. Right of withdrawal
This provision applies exclusively to consumers. The agreement can be revoked without giving reasons within 14 days from delivery.

The goods must be returned in the original packaging, with all accessories supplied and in their original condition, as much as possible. The customer is liable for any depreciation resulting from use beyond what is necessary to establish the nature, characteristics and functioning of the product.

Within 14 days after receipt of the withdrawal notice, the amounts paid will be refunded via the payment method used, unless there is a reduction in value. **OnFoil can wait with the refund until the goods have been received back.

A standard withdrawal form is available upon request.
